Oklahoma’s capital gain deduction for in-state property
Oklahoma rewrote its brackets for 2026: no tax on the first $3,750 of taxable income for single filers ($7,500 joint), then 2.5%, 3.5% and a 4.5% top rate. Ordinary investment gains are taxed through those bands, and a single filer moving from $60,000 to $110,000 of Oklahoma taxable income owes $2,250 more, all at 4.5%.
Gains on Oklahoma assets can be deducted entirely: real property located in Oklahoma owned at least five years, an ownership interest in an Oklahoma company held at least two years, and certain Oklahoma business assets. Stock in companies headquartered elsewhere does not qualify. Document the location and the holding period before claiming the deduction.
Oklahoma approved resident annual comparison
Oklahoma’s enacted 2026 income-tax changes replace the former lower bands and reduce the top rate to 4.5%. In the Tax Commission’s legislative summary, single and separate filers cross bracket lines at $3,750, $4,900 and $7,200; for joint filers, heads of household and qualifying surviving spouses each line doubles, to $7,500, $9,800 and $14,400. The first band has zero tax, followed by 2.5%, 3.5% and 4.5% rates.
The Oklahoma capital-gain deduction requires qualifying property, location and holding-period conditions. The state worksheet distinguishes eligible Oklahoma real property, ownership interests and business-asset dispositions; a sale is not exempt simply because the taxpayer lives in Oklahoma. Prepare state basis, transaction eligibility, netting and the approved deduction before supplying annual taxable balances.
Use the new annual schedule on approved resident taxable income and complete usable nonrefundable credits. The agency-authored legislative summary is hosted in the state library and supplies the current-year enactment; an older filing packet is retained only for its dated continuing preparation mechanics. Future revenue-trigger reductions are not assumed. Source allocations, additional taxes and final filing-table effects require entered final liabilities.
