Delaware brackets and the 60-plus exclusion

Delaware taxes gains as ordinary income. With the 6.6% top rate starting at only $60,000 of taxable income, most meaningful gains are taxed almost entirely at 6.6%: a single filer at $60,000 who adds $50,000 of gain pays $3,300 more, taking the schedule from $2,943.50 to $6,243.50.

Two features soften this for some sellers. Residents aged 60 or older can count capital gains toward Delaware’s pension and retirement income exclusion, up to its annual limit, and Delaware has no sales tax that would add to the cost of selling personal property. Wilmington’s city wage tax is a separate local levy outside this estimate, and a nonresident who sells Delaware real estate still files a Delaware return for that gain.

Delaware approved resident annual comparison

Delaware’s current statutory resident schedule has seven bands. Approved taxable income through $2,000 has zero schedule tax; successive rates are 2.2%, 3.9%, 4.8%, 5.2%, 5.55% and 6.6%, with the top band above $60,000. The cumulative base at that boundary is $2,943.50. These ordinary income bands apply to approved state taxable amounts rather than federal 0% / 15% / 20% preferential bands.

Age-dependent exclusions can affect a gain comparison. Delaware agency guidance permits eligible taxpayers age 60 or older to include qualifying investment income, including capital gains, within the applicable retirement-income exclusion limit. This is a taxpayer-specific annual allowance, not an unrestricted exemption for every asset sale. Social Security and railroad retirement treatment and other state adjustments also belong in the prepared income reconciliation.

Prepare annual Delaware taxable income after actual exclusions and deductions for each scenario, then enter complete usable nonrefundable credits. The calculator repeats the statutory schedule in cents and compares net annual estimates. Wilmington wage tax, source allocation, special additional taxes, payments and final-return table effects are outside this resident calculation. Use the final-liability option when those amounts affect the comparison.
